INTRODUCTION North Carolina’s present sterilization law was passed by the General Assembly of 1933. The law provides specifically for the sterilization of three types of cases upon authorization of the Eugenics Board: “(1) the feebleminded, (2) the epileptic, and (3) the mentally diseased.” These persons may be sterilized when it is believed that: (1) An operation would be for the best interest of the person concerned; (2) An operation would be for the public good; or when (3) A child or children might be born who would have a tendency to serious mental or nervous disease or deficiency. The heads of state institutions and county superintendents of public welfare are designated by law to institute sterilization proceedings by filing petitions with the Eugenics Board. The 1933 statute provides for both hearing and right of appeal. The members of the Eugenics Board, specified in the law, assure careful consideration of each petition from the social, physical, psychological, psychiatric, and legal viewpoint. The members are: The Commissioner of Public Welfare, the secretary of the State Board of Health, the chief medical officer of an institution for the “feebleminded” or mentally ill of the State of North Carolina not located in Raleigh, the chief medical officer of the State Hospital at Raleigh, and the Attorney General of North Carolina. The experience of the Eugenics Board over a period of 25 years has led to the conclusion that the sterilization program should be based on education and on careful study of each case. Not only is great responsibility vested in the Board itself, but the successful administration of the program depends largely on the petitioners and their staffs. They are the ones who help the individuals considered for sterilization and their families to understand the meaning of sterilization so that they will consent voluntarily to the operation.
