26 Pharmacy Laws A and B is deemed guilty of a misdemeanor and upon conviction shall be fined or imprisoned at the discretion of the court. C. S. 6683. SECTION 57. PROSECUTION FOR SALES OF PATENT AND PROPRIETARY MEDICINES. No prosecution shall be brought for the sale of any patent or proprietary medicine containing narcotic drugs until the Board of Pharmacy shall certify that such medicine contains any of the said drugs in excess of the maximum percentage permitted. C. S. 6683. SECTION 58. DUTY OF JUDGES. All judges of the superior courts in this State should charge all regularly impanelled grand juries to inquire diligently into and investigate all violations of such provisions and to make a presentment of all persons guilty of such violations. C. S. 6683. SECTION 59. SALE AND ADVERTISING OF CERTAIN PATENT CURES AND DEVICES UNLAWFUL. (1) Sale Prohibited.�No person, firm, association, or corporation in this State may sell or offer for sale any proprietary or patent medicine or remedy purporting to cure cancer, consumption, diabetes, paralysis, or Bright's disease or any other disease for which no cure has been found, or anv mechanical device whose claims for the cure or treatment of disease are false or fraudulent. (2) Advertising Prohibited�Nor may any person, firm, association, or corporation advertise in any manner whatsoever any of the medicines above mentioned or anv mechanical device for the treatment of disease when the State Board of Health shall declare that the device is without value in the treatment of disease. (3) Penalty for Violation.�Any person violating this section is guilty of a misdemeanor and upon conviction shall be fined not more than $100.00 for each offence.
